1. Introduction

This privacy policy has been compiled to better serve those who are concerned with how their ‘Personally Identifiable Information’ (PII) is being used online.

Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.

Please note that this Privacy Policy governs only information provided to Climate Synergy and communications from Climate Synergy. It does not govern any other information or communications that may reference Climate Synergy, e.g., communications from partners or external service providers. This Privacy Policy was last updated on July 1, 2024.

2. Information Collection

We do not collect personally identifiable information about you, except when you provide it to us directly or through a third party. For example, if you decide to complete a training registration form, participate in an online survey, or make a purchase, you may be asked to provide certain information such as your contact information (name, email address, mailing address, and telephone number), job title, organization, and areas of interest in ESG training and consulting services. If you decide to enroll in our self-led courses, we may also need to know your billing address, credit card number, and expiry date. Please note you may be transferred to a third-party service provider’s website to submit this information.

Sensitive information is not generally sought through this Climate Synergy Site. Sensitive information includes data relating to race or ethnic origin, political opinions, religious or other similar beliefs, and physical or mental health.

If you would prefer that we not collect any personally identifiable information from you, please do not provide us with any such information. Please note that if you do not wish to provide any personal information, you will not be able to register for our courses or services on this Site.

  • 2.1. Communications to Serve You: If you have elected to provide us with your contact information, E.G., by registering on the Climate Synergy Site, emailing our Customer Service department, or placing an order for our virtual courses, we may provide you with service-related announcements concerning the Climate Synergy Site or contact you regarding your customer service requests or your training order. We may also contact you to respond to any questions or concerns you may express regarding our services. These types of communications are necessary to serve you, respond to your concerns, and provide the high level of customer service that we offer our clients.

    Prior to your submission of your personally identifiable information to this Climate Synergy Site, you will be asked whether you consent to the processing and transfer of your personal information in accordance with this Privacy Policy. If you consent, you will be able to submit your information to this Climate Synergy Site. 

3. Protecting your information

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular Malware Scanning. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a client makes a payment, enters, submits, or accesses their information to maintain the safety of your personal information. All transactions are processed through a gateway provider and are not stored or processed on our servers.

4. Do we use 'cookies'?

A cookie is a piece of data that enables us to track and target your preferences We do not use cookies for tracking purposes You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings. Since each browser is a little different, look at your browser’s Help Menu to learn the correct way to modify your cookies.

5. CONSENT TO 3RD-PARTY BRAND USE

By engaging our services and making payments for our services, you agree that your company name and / or company logo may be used on our website, proposals, and marketing collateral for promotional purposes. 6. Third-party disclosure

We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information unless we provide users with advance notice. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our clients so long as those parties agree to keep this information confidential. We may retain other companies and individuals to perform functions consistent with our Privacy Policy on our behalf. Examples include customer support specialists, webhosting companies, credit card processing companies, fulfilment companies (e.g., companies that fill product orders or coordinate mailings), data analysis firms and email service providers. Such third parties may be provided with access to personally identifiable information needed to perform their functions, but may not use such information for any other purpose.

7. Use of Personally Identifiable Information by Climate Synergy

We may share your personally identifiable information with our affiliates and other divisions of our company that market Climate Synergy’s ESG training and consulting. These Training Partners may use this information in accordance with this Privacy Policy.

8. No Disclosure of Personally Identifiable Information for Third Party Marketing Without Your Consent

We will not provide your personally identifiable information to third parties for their use in marketing their products or services to you without your consent.

9. Disclosure of Personally Identifiable Information

  • 9.1. Fraud Protection and Compliance with Law: We may release information when it’s release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property or safety disclose any information, including personally identifiable information, we deem necessary, in our sole discretion. This is to enable us comply with any applicable law, regulation, legal process or governmental request. We may also exchange information, including personally identifiable information, with other companies and organizations for credit fraud protection and risk reduction. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
  • 9.2. Business Transfers: As we continue to develop our business, we might sell certain of our assets. In such transactions, user information, including personally identifiable information, generally is one of the transferred business assets, and by submitting your personal information on the Climate Synergy Site you agree that your data may be transferred to such parties in these circumstances.

10. Transfer of Data to Other Countries

The third parties referenced in Sections 3 and 5 who will receive your information only for the purposes set forth in this Privacy Policy, the third parties with whom you direct us to share your information referenced in Section 4 and the databases in which your personally identifiable information may be stored may be located both inside and outside the United States (“US”) and the European Union (“EU”). By providing personally identifiable information to this Climate Synergy site, you acknowledge and accept that the third party which receives your personally identifiable information may be located within a state or country which does not guarantee the same level of protection for personally identifiable information as the one in which you reside.

REFUND, CANCELLATION, AND DEFERMENT POLICY

1. CANCELLATION POLICY

By completing your registration for a course and making a payment of full or installment fee, you agree to the funder-listed Terms and Conditions:

1.1. Cancellation – Learner Eligibility

a. You are entitled to cancel your class by requesting “course cancellation” 10 days before the course start date. Course start dates are publicly published on our website, via emails and made available to all learners.
b. Cancellations done within less than 10 days and more than 5 days shall be entitled to a 50% refund only.
c. Cancellation of a course lless than 5 days prior to the program will attract NO refund, and learners will be obliged to complete the training program which has been started.
d. Organizations and learners who pay for a course late (that is lesser than 5 days before the start date) cannot cancel their course.

1.2. Cancellation – Climate Synergy Eligibility

a. Climate Synergy has a minimum class size of 6 participants to hold an open nomination training programme.

b. Where the minimum class size is not attained, Climate Synergy reserves the right to reschedule the specific course, which will be duly communicated within four (4) days prior to the commencement of the scheduled training class.

c. Act of God/ Force Majeure: Where a Force Majeure event prevents Climate Synergy from conducting a scheduled training program, Climate Synergy reserves the right to cancel the training program without any liability to the Partner or participants. Climate Synergy shall use its best effort to:

I. Notify: Climate Synergy shall notify the registered participants as soon as reasonably practicable of the decision to cancel the training program due to a Force Majeure event.
II. Reschedule: We will endeavor to reschedule the affected training program to a new date as soon as reasonably practicable, taking into account the nature and duration of the Force Majeure event.
III. Refund: In the event that the training program cannot be rescheduled, Climate Synergy shall fully refund any fees paid by participants for the canceled training program where requested.

d. In the event of clause 2.2.c, participants may request to transfer or defer their registration.

e. Fully or partially paid up participants shall also be entitled to a full refund where requested.


1.3. PROCEEDURE:
Cancellations are ONLY accepted in writing or via email.
a. For a full refund, written cancellations must be received 10 days prior to the start date of the training.
b. Where a refund is permitted, payment shall be made to the same account through which payment was received.
c. Please allow for 48 hours for all refunds to be processed.

2. Transfer Policy

  • 2.1. ELIGIBILITY

Participants are entitled to transfer a registration to another open nomination training program provided such subsequent program is of the same duration, cost and mode of delivery. Transfers are valid for 3 months only. 

  • 2.2. PROCEEDURE:
  1. Transfer Requests must be made in writing and via email.
  2. Transfers may be made up to 10 business days prior to the training start date at no cost.
  3. Transfer requests made within or less than 5 days of the course shall be accepted at the discretion of The Climate Synergy.
  4. Transfers cannot be made after the training has commenced.
  5. Where a program is canceled by The Climate Synergy, a transfer can be made for a future training with no fee. We will attempt to deliver the training program as soon as reasonably possible.

3. Program Deferment Policy

  1. A learner who for some reason(s) is unable to begin a program as at when due and wants to defer to the next cohort may defer provided, the deferment is for the same course and to the next scheduled cohort as indicated in the published training calendar.
  2. Deferment to any other cohort beyond the next cohort is NOT permitted, and a refund WILL NOT be processed for such a situation, and the student will forfeit the amount paid for that program.

4. Substitution Policy

Participant substitutions are accepted in writing via email, or written letter by providing the name of the current registrant and the name of the substitute. Substitutions may be made up to 1 business day prior to the training for no fee.
